The Criminal Justice System Is Not Perfect

Every defendant in a criminal case enjoys a constitutional right to appeal. Obviously, one would prefer to avoid the need to appeal in the first place, but often circumstances (and sometimes lawyers) intervene to prevent a just result. We routinely conduct inquiries on how best to handle an appeal in either state or federal court.

Grounds for Appeal — Criminal Cases

Criminal appeals typically turn on the conduct of the trial judge, the prosecutor and sometimes even defense counsel. Whether a ruling on an objection or giving a charge to the jury, a trial judge’s decisions should be subjected to the strictest scrutiny for fairness, accuracy and absence of bias.

Prosecutors have well-established obligations to follow, and their failure to do so can upset a conviction. Finally, your own lawyer has a duty to give you “effective assistance of counsel.” We analyze the conduct of all three without fear or favor and pursue appeals as aggressively as any other case in pursuit of justice for our clients.
We are routinely called upon to review case files and transcripts and offer first or second opinions on the likelihood of a successful appeal or petition for post-conviction relief, commonly known as habeas corpus. Civil Appeals, New Jersey and Federal

Although we prefer to handle civil cases from their inception, it doesn’t always work that way. Over the years, many plaintiffs and defendants have contacted us after losing a civil case, facing tight deadlines for appealing an adverse verdict. As veteran trial attorneys who also maintain a healthy appellate practice, we are ready to move on civil appeals faster than most large law firms.
We are acutely familiar with the often arcane rules of appellate procedure in both New Jersey and federal appeals courts.
